Welcome to Logger. These Terms of Service (“Terms”) govern your access to and use of the Logger website, applications, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. About Logger

Logger is a cloud-based communication platform that helps contractors, builders, remodelers, and other service professionals share project updates, photos, documents, messages, and related information with their clients.

Logger is a communication tool only. Logger is not a party to any construction contract, remodeling agreement, service agreement, or other transaction between users and their clients.

2. Eligibility

You must be at least 18 years old and capable of forming a legally binding agreement to use the Service.

If you use Logger on behalf of a company or organization, you represent and warrant that you have authority to bind that entity to these Terms.

3. Accounts

You are responsible for:

• Maintaining the security of your account
• Keeping your login credentials confidential
• All activities that occur under your account
• Providing accurate account information

You must promptly notify Logger of any unauthorized use of your account.

4. Subscription Plans and Payment

Certain features of the Service may require payment.

By purchasing a subscription, you agree to pay all applicable fees and taxes.

Subscriptions automatically renew unless canceled before the renewal date.

Logger may change pricing at any time. Existing subscribers will receive reasonable notice before any pricing changes take effect.

Failure to pay subscription fees may result in suspension or termination of access to the Service.

5. Free Trials

Logger may offer free trials or promotional access periods.

At the conclusion of a trial period, your account may be converted to a paid subscription unless canceled prior to the trial expiration date.

Logger reserves the right to modify or terminate trial offers at any time.

6. User Content

You retain ownership of all photos, documents, messages, project information, and other content you upload, submit, or transmit through the Service (“User Content”).

By using Logger, you grant Logger a limited, non-exclusive, worldwide license to host, store, process, transmit, display, and reproduce User Content solely as necessary to operate and improve the Service.

You represent and warrant that:

• You own or control all rights necessary to upload User Content
• Your User Content does not violate any law or third-party rights
• You have obtained any required permissions from clients, homeowners, employees, or other individuals whose information may appear in the content

7. Communications and Consent

You are solely responsible for obtaining any required consent before sending communications through Logger.

You agree to comply with all applicable laws relating to email, text messaging, marketing communications, privacy, and consumer protection.

Logger does not provide legal advice regarding communication compliance.

8. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes
• Send spam or unsolicited communications
• Harass, threaten, abuse, or harm others
• Upload malicious code, viruses, or harmful software
• Attempt to gain unauthorized access to the Service
• Interfere with the operation of the Service
• Reverse engineer or copy the Service
• Use the Service to violate any law or regulation

Logger may suspend or terminate accounts that violate these rules.

9. Construction and Project Information Disclaimer

Logger is a communication platform only.

Logger does not:

• Verify project information
• Guarantee the accuracy of updates or documents
• Provide construction advice
• Provide engineering advice
• Provide legal advice
• Monitor project quality or performance

Users are solely responsible for all project-related communications and decisions.

10. Service Availability

Logger strives to provide reliable service but does not guarantee uninterrupted access.

The Service may occasionally be unavailable due to:

• Maintenance
• Software updates
• System failures
• Internet outages
• Third-party service interruptions

Logger may modify, suspend, or discontinue any feature at any time.

11. Third-Party Services

The Service may rely on third-party providers for hosting, messaging, authentication, payments, email delivery, SMS delivery, storage, analytics, and other functionality.

Logger is not responsible for interruptions, errors, or failures caused by third-party services.

12. Intellectual Property

Logger and its associated software, trademarks, branding, content, designs, and technology are owned by Logger and protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, no rights are granted to you.

13. Feedback

If you provide suggestions, ideas, comments, or feedback regarding Logger, you grant Logger a perpetual, irrevocable, royalty-free right to use and incorporate such feedback without compensation or attribution.

14. Beta Features

Logger may offer beta, preview, experimental, or early-access features.

Beta features are provided “as is” and may contain bugs, inaccuracies, interruptions, or incomplete functionality.

Logger may modify or discontinue beta features at any time without notice.

15. Disclaimer of Warranties

The service is provided “as is” and “as available.”

To the maximum extent permitted by law, Logger disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

Logger does not guarantee that: the Service will be error-free; communications will be delivered; data will never be lost; or the Service will be available at all times.

16. Limitation of Liability

To the maximum extent permitted by law, Logger shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Logger's total liability arising out of or related to the Service shall not exceed the greater of: (A) the amount paid by you to Logger during the twelve (12) months preceding the claim; or (B) one hundred U.S. dollars ($100).

17. Indemnification

You agree to defend, indemnify, and hold harmless Logger and its owners, employees, contractors, affiliates, and agents from any claims, damages, liabilities, losses, costs, and expenses arising from:

• Your use of the Service
• Your User Content
• Your communications with clients
• Your violation of these Terms
• Your violation of any law or third-party rights

18. Termination

You may stop using the Service at any time.

Logger may suspend or terminate your access at any time if:

• You violate these Terms
• Your account poses a security risk
• Required by law
• The Service is discontinued

Upon termination, your right to access the Service immediately ends.

19. Privacy

Your use of the Service is also governed by Logger's Privacy Policy, which is incorporated into these Terms by reference.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict-of-law principles.

21. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Clark County, Nevada.

You consent to the personal jurisdiction of those courts.

22. Changes to These Terms

Logger may update these Terms from time to time.

Updated Terms become effective when posted on the Service.

Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
